Dude, not even close. Using that logic you could say Iron Maiden ripped off The Monkees (as per your post a couple weeks back). This is nowhere near the "Ghostbusters" and "I Want a New Drug" clash from the 1980's. Not to mention that has to be one of the worst KISS songs EVER!
Hmmm. To my ear, it is exactly the same musical phrase. But, let's face it, the tacitly "allowed" melodies in pop, folk, and hard rock are pretty limited (I'm not talking about production, talent, chords, or timbre here, just the melodies). As far as I can tell, there's essentially no new melodies anymore in those genres because the understanding of what "sounds good" is so limited. Most of the novelty is in production, branding, style, and presentation. I suspect this ripping-off effect will become more and more of a problem as popular music degenerates further into a bland, homogeneous mush. The pop/rock genre has become more about having an original style and presentation, not original songs. However, obviously sky's the limit if you open up the musical space to "free form" or to what might be considered "jazzy" or "classical" or "world music".
End pedantic rant.

Sounds like a total rip off to me. Of course there's that song on Revenge where KISS totally rips off "Summertime Blues" so I guess they had it coming.
